Packaging law and packaging report + video

 

Packaging law lays down that the packaging undertaking has an obligation to keep records of packaging and to collect and recycle packaging.

A packager is a person who, in the course of his business or profession, packages goods, imports or sells packaged goods. According to the law, a packaging report must be submitted by every company that places packaged goods on the Estonian market for the first time. In addition, a packaging undertaking, unless it is acting solely as a reseller, is obliged to organise the collection and recovery of packaging placed on the market and of waste arising from it, in accordance with the rates laid down by law, and to bear the costs associated with this.

From 1 January 2023, all packaging companies will be required to submit a packaging report, regardless of the quantity of packaging. This means that packaging will have to be accounted for from the moment a company puts the first packaged product on the market, no matter how small the quantity.

 

The recycling obligation applies to all companies, regardless of the quantity, i.e. a company must ensure that the packaging it places on the market is recycled or transfer this obligation to a recycling organisation.

Packaging can be categorised according to its purpose, reuse, material and other characteristics..
It is important to classify packaging correctly, as different types of packaging and different materials have different take-back and recovery requirements.

Packaging is a product made of any material used for containing, protecting, handling, transporting or presenting goods throughout their life cycle, from the moment they are produced until they reach the consumer. Single-piece packaging used for the same purpose is also considered packaging.

A packaging contractor may subcontract its statutory collection and recovery obligations to an accredited recovery and recycling organisation (ARO) by entering into a written contract. In this case, TKO will organise the collection and recovery of packaging on behalf of the company. The frequency of reporting is chosen by the company according to the specific nature of its activities: monthly, quarterly, half-yearly or annually.

The data must be disaggregated by type of packaging and material and submitted to the Packaging Register.
